Condominiums are the minority product on Samui. The island has no high-rise skyline, building height is capped, and most apartment schemes are low-rise blocks of ten to sixty units in Bo Phut, Maenam and Lamai. What they offer a foreign buyer is the one thing a villa cannot: a freehold title in the buyer’s own name, provided the building is a registered condominium and the foreign quota is not yet full.
Not every apartment on Samui is a condominium in the legal sense. Some are sold as apartments on a long lease because the building was never registered under the Condominium Act. Purchase money for a freehold unit must arrive from abroad in foreign currency and be documented with a Foreign Exchange Transaction form. In an unregistered apartment building the foreign buyer takes a registered lease, typically 30 years, and some developers offer renewal clauses.
The 49 percent figure is the law, not a promise about a specific building. Whether a given project still has foreign quota available is a question for the developer at the time of reservation.
